Layoverly is a tool designed to assist airline flight crews in managing logistics. The Service is for informational purposes only.

• Final Authority: You acknowledge that you are solely responsible for your own flight schedule, transportation, and compliance with all FAA, airline, and regulatory requirements.
• Crew Rest & Regulations: You are responsible for ensuring your own compliance with 14 CFR Part 117 (or applicable international crew rest regulations). Layoverly does not track, certify, or guarantee legal rest periods.

3. Third-Party Services and Links

The Service may contain links to, or integrations with, third-party websites or services (including, but not limited to, ride-sharing platforms, hotel booking engines, and airline crew portals).

• No Endorsement: Layoverly, LLC does not own, operate, or control these third parties.
• Independent Contractors: You acknowledge that third-party providers (such as Uber or Lyft drivers) are independent contractors and not employees or agents of Layoverly, LLC.
• Assumption of Risk: Your use of third-party services is at your own risk. Any disputes, service failures, or safety concerns must be resolved directly with that provider.
• Liability Shield: Layoverly, LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of such third-party services.

4. Limitation of Liability & Disclaimer of Warranties

To the maximum extent permitted by law:

• "As-Is" Basis: The Service is provided without warranties of any kind.
• Missed Connections/Transportation: Layoverly, LLC shall not be held liable for any missed flights, missed ground transportation, or delays, regardless of cause.
• Crew Rest Violations: We are not responsible for any disciplinary actions or safety incidents resulting from a violation of crew rest requirements.
• Consequential Damages: In no event shall Layoverly, LLC be liable for any indirect, incidental, or punitive damages (including loss of wages or employment).

5. Intellectual Property & Copyright

All content and functionality (including text, graphics, logos, and code) are the exclusive property of Layoverly, LLC. You are granted a limited, non-exclusive license to use the app for personal, professional use only.

6. Indemnification

You agree to indemnify and hold harmless Layoverly, LLC from any claims, damages, or expenses (including legal fees) arising from your use of the app or your violation of these Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado.

• Location Data: We may collect location data to facilitate logistics and coordination among crews.

2. How We Use Your Information

We use your data to provide logistics assistance and improve app functionality. We do not sell your personal data to third parties.

3. Third-Party Integrations and Data Transfers

When you interact with a third-party service (e.g., Uber/Lyft) through Layoverly, that third party becomes a "Data Controller" of the information sent to them. Use of these services is governed by the respective third party's Privacy Policy.

4. Data Security & Breach Protocol

We implement industry-standard security measures. In the event of a data breach, we will notify affected users in accordance with Colorado's Data Breach Notification Law (C.R.S. § 6-1-716).

5. Data Sharing

We may share your information with other crew members (limited to coordination), if required by law, or with service providers bound by confidentiality.

You may view, edit, or delete your personal information through your account settings at any time.
